Supreme Court Says Cannot Reinstate Zelaya

The President of Magistrates of the the Supreme Court of Justice, Theodor Bonilla, assured today that the judicial system does not have the constitutional facility to reinstate Manuel Zelaya, and that the Congress does not have the authority, and is not above the Magne Carta. Congress and the political system cannot be above the Constitution of the Republic.

“We have to put things in perspective. From a judicial standpoint, and in view of the Constitution of the Republic of Honduras, the Supreme Court’s only facility according to the Constitution, is to judge, and execute the enforcement of those judgments.”

According to Article 242 of the Constitution, which deals with the succession of the President, if there is no Vice President, the position of President is to be occupied by the legislative power (the President of Congress – Micheletti).

If that person does not accept being President of the Republic, the President of the Supreme Court is to assume the Presidency. If the President of the Supreme Court also refuses that position, the Presidency would then go to the Minister of Government and Justice. In the case of the President of the Supreme Court or the President of Congress assuming the Presidency of the Republic, there is nothing in the Constitution that obligates them to take the post. This is the only way that a judicial end of the current political crisis can be constitutional.

The restitution of Zelaya does not fit into any judicial view. What should happen is the succession laid out by the Constitution of the Republic. In all the articles of the Constitution, there is no judicial way to constitutionally reinstate Zelaya.

    It appears that the present government of Honduras can do no wrong, with respect to defending their Contitution. They are making fool’s of all the leftest in the world. Micheletti deserves the Peace Prize. Obama deserves the Fool’s Prize. Chavez deserves a padded cell.

    and those are the facts and it is strait forward and all …meetings , proposals, etc. will not change the constitution………..mel and his people keep changing the question hoping to come up with a different answer but that doe’s not work….and mel..if hillary’s offer to bring you to the u.s.a. is still good , you better grab it soon ………ther are some good old boys in prison waiting for you………….
