Evidence Rejected in Chimirri Case

The trial courts rejected evidence presented by the prosecution against Marcelo Chimirri, former manager of the Honduran Telecommunications Company (Hondutel), this morning. Chimirri is accused of the crimes of abuse of authority, fraud and bribery in the scandal of the U.S. company Latinode.

The judge overseeing the case felt that the evidence presented by prosecutors was not strong enough, according to Prosecutor Anibal Ramirez. Before the ruling, the prosecution filed an objection for annulment against the decision issued by the court.

“We have submitted the photocopies authenticated by the signature of the director general of Hondutel, who serves as the secretary to the board of Hondutel … What we want to prove is a notorious fact that the accused was the manager of Hondutel,” said Ramirez.

The release of the former chief of Hondutel depends on the trial court because the claim is to be dismissed, but the prosecution allegedly has presented other reliable evidence. The resolution has yet to be decided in the courts of the capital today.

Chimirri was captured on July 2, 2009, while conducting financial transactions in a bank located on the Boulevard Morazan.

On April 9, 2009, the company Latinode pleaded guilty in federal court in Miami to paying bribes of more than 1.09 million dollars to Honduran officials in exchange for preference in the international calling rates.

Chimirri and the former managers James Lagos, Jorge Alberto Rosa, former legal counsel and auditor Danilo Santos Daniel Flores, are all accused in the bribery.
