Editorial: Vacation Time for Manuel Zelaya?

The judiciary are on vacation until the new year, perhaps providing an excellent opportunity for the former president of Honduras, Manuel Zelaya Rosales, to slip in to Honduras to visit with his family over the holidays.

Albeit, it won’t be quite as easy as that. There are in actuality, some cases that may come before the court during the yearly recess, and would be heard by one of just a few judges who are ordered to work the holiday by the courts coordinator, Emily Page.

Not surprising to most is the fact that one of the judiciary elected to continue working through the holiday is Judge Claudio Aguilar. It came as a surprise to Judge Aguilar however, as he was not notified of this until late in the afternoon on Friday. Mr. Aguilar is the judge assigned to oversee the case involving one Mr. Manuel Zelaya.

Unlike other countries, it is not legal in Honduras for one judge to hear and rule on a case assigned to another judge. Therefore, if Mr. Zelaya were to present himself over the holiday, he would not be turned away due to lack of the appropriate judge being available to hear his case.

In fact, as recent as last week, three attorneys were assigned to serve as public defenders for Mr. Zelaya, indicating to most that he may soon be deciding to return to Honduras and present himself to the courts to face the charges against him. The Public Ministry over a year ago formally charged Mr. Zelaya with embezzlement of public funds, fraud, and falsification of documents. President Porfirio Lobo Sosa, however, has said that if Mr. Zelaya returned to Honduras, he would not be imprisoned for the crimes of which he is accused.

As a side note, the coastal town of La Ceiba yesterday held a fishing tournament. Many boats that might normally appear suspicious under other circumstances, were strewn about the outlying waters, basically coming and going to various islands and cays. It is alleged that the United States Ambassador to Honduras, Hugo Llorens, was transported to the southeastern cay by boat to meet there with Manuel Zelaya.

Interestingly enough, just this morning, strong military forces in full armor were occupying Utila’s runway. They were brought in and left by boat, not aircraft. It certainly could lead one to assume that something of significant importance is underway in the area this holiday week.

Now that it has been all but confirmed that the former president has been on Honduran soil as recently as yesterday, the speculation is whether he will decide to present himself to the court on the mainland, or say it was a nice respite and head back to his comfortable self imposed prison in the Dominican Republic where he is treated as an honored guest.
