Hondutel Former Legal Adviser in the Pen

Yesterday afternoon, Óscar Danilo Santos was handcuffed and sent to the National Penitentiary.

The former legal adviser to Hondutel is accused by prosecutors of committing several crimes, including stealing secrets which endangered people’s freedom and personal safety.

Óscar Danilo Santos initially presented himself voluntarily to the court, and was granted substituted measures at his initial hearing – an alternative to being imprisoned while awaiting his trial date. He was later declared in default by failing to continue to check in when required.

In the absence of compliance with the measures, the prosecution presented at the First Court of Appeals, a petition against the alternative option. The Court of Appeals ruled in favor of the prosecution, and ordered that alternative measures were changed, and Danilo be transferred to the National Penitentiary.

The notice of the revocation action was scheduled for Monday, September 6th, but at the request of the defense, the appeal was rescheduled for yesterday. The defense has filed another appeal with the Constitutional Chamber of the Supreme Court, but it has not yet been ruled on.

Óscar Danilo Santos is accused of wiretapping during the government of Manuel Zelaya. Zelaya claimed that several conversations between him and his staff were being recorded and broadcast on the YouTube social network. Zelaya brought his complaint to the Military Police, who after investigation, discovered it was Zelaya’s own officials who were behind the recordings. Danilo Santos, Luis Arriaga, and Marcelo Chimirri, were all three accused of the crime of espionage.

Chimirri and Arriaga are also awaiting trial.
